			<content:encoded><![CDATA[<p>I&#8217;ve been away from my keyboard awhile, completing a grueling project at my day job. But I&#8217;ve followed the release of the torture memos by the Justice Department and the ensuing debate.</p>
<p>Sometimes I&#8217;m baffled by our collective ability to miss the obvious.</p>
<p>Ask yourself this: Since when does the President of the United States get to decide who is, or is not, prosecuted for a federal crime? Where is it written that a president can determine that a certain class of people, believed to have committed crimes, can not even be investigated?</p>
<p>President Obama can express his views about whether to enforce the laws against torturing prisoners, but ultimately, the decision to prosecute or not, belongs in the Justice Department.</p>
